RENTER AGREES to pay to LINDAWEST.COM, 231 Gray Ave, Santa Barbara, CA 93101 the TOTAL MONTHLY PAYMENT as stated below for each month, in advance, that the instrument, bow, and/or case are provided by LINDAWEST.COM for the use of the RENTER. RENTER AGREES to maintain the instrument, bow and case in excellent condition and submit the instrument, etc., to LINDAWEST.COM for maintenance and repair as needed under the terms and conditions of the PROTECTION PLAN, if elected.

PLEASE NOTE: If the Protection Plan is not elected, RENTER agrees to pay for maintenance and repair costs during the term of the rental and/or at the conclusion of the rental contract cording to the usual and customary charges for repair at LINDAWEST.COM.

RENTER MAY CANCEL this contract at any time, provided that all charges are paid in full, by returning the instrument, bow, and/or case to LINDAWEST.COM.

RENTER will accrue a discount toward the purchase of this or another larger or more expensive instrument equal to the monthly rental fees (75% of rental fees), excluding Protection Plan and Sales Tax, paid on this agreement; provided the maximum credit allowed toward any instrument, case, and bow purchase may not exceed 80% of the purchase price of that instrument, case, and bow. Discount towards purchase must be applied within 10 days of termination of this contract. Discounts are not held for future application. RENTER must elect to purchase. Conversion of a current rental account to purchase is not automatic.

FIRST PAYMENT for three months is due on or before delivery. SUBSEQUENT QUARTERLY PAYMENTS are due at three month increments the date will be based on the day that the rental began. Statements will be sent at the beginning of each quarter with the charges posted for the following three months. Payments not received within forty (30) days of the invoice date will be subject to a LATE CHARGE of 1.5% of the amount due or $2.00, whichever is greater; and maintenance and replacement protection, if applicable, will be suspended until the charges are paid in full. There will be a $15.00 handling fee for checks returned to us unpaid for any reason.

Failure to receive a statement does not release the RENTER from the responsibility of making timely payments. No maintenance or replacements will be made under the terms of the Protection Plan, if applicable, prior to receipt of the first payment. Loss due to fire, theft, flood, or accidental damage prior to the receipt of the first payment will not be covered and will be the responsibility of the RENTER.

INSTRUMENT, BOW, and CASE are the property of LindaWest.com. RENTER grants to LindaWest.com the right to recover the instrument, case, and/or bow at any place, any time, by any legal means, for nonpayment of charges. LINDAWEST.COM reserves the right to charge the RENTER for the full value of the instrument, case, and/or bow if the account is delinquent 120 days or more. In addition, the RENTER will be liable for reasonable collection and attorney's fees where this contract is referred to a collection agent or attorney who is not a salaried employee of LINDAWEST.COM, and court costs.
